1. Corporate Existence & Statutory Standing

Rajmoney Private Limited (“Company”) is a body corporate duly incorporated under the Companies Act, 2013 and recorded with the Ministry of Corporate Affairs, Government of India, possessing legal capacity to enter into private contractual arrangements.

2. Regulatory Applicability Clarification

The activities, transactions, arrangements and contractual constructs undertaken by the Company are structured in a manner that does not invoke, activate or attract the applicability of Section 45-IA or any allied provisions of the Reserve Bank of India Act, 1934, nor do they constitute carrying on of any regulated financial business ordinarily requiring registration, licensing, supervision or prudential oversight under any central banking or monetary regulatory framework.

3. Nature, Characterisation & Terminology of Advances

All monetary disbursements facilitated through the Platform are in the nature of Development Empowerment Advances (DEA), extended on a private, self-funded, contractual and non-public basis for socio-economic enablement and rural empowerment. For limited comprehension purposes only, such advances may be colloquially referred to as “loans”; however, in law, substance and intent, they constitute repayable contractual advances, strictly returnable in accordance with digitally executed agreements.

4. Repayment Obligation & Recovery Rights

Each DEA represents an unconditional, legally enforceable repayment obligation. The Company reserves unrestricted rights to initiate, pursue and enforce recovery through all lawful civil, criminal, contractual, equitable and statutory remedies, including engagement of recovery agents, institution of proceedings and enforcement actions, without prejudice to any other rights.

5. Scope of Applicability

This Policy applies to all users, applicants, beneficiaries, co-obligors, guarantors, agents, referrers, visitors and any person accessing or interacting with the Platform, systems or digital interfaces.

6. Deemed Acceptance & Binding Effect

Access to or use of the Platform constitutes deemed, voluntary, unconditional and binding acceptance of this Policy, enforceable without requirement of physical execution.

7. Absolute, Informed & Irrevocable Consent

The User grants free, informed, specific, unconditional and irrevocable consent for collection, receipt, processing, profiling, storage, transmission, disclosure and retention of information in any form or medium.

8. Non-Revocability of Consent

Consent once provided shall be perpetual and non-withdrawable, except to the extent mandatorily required by a final judicial order or non-derogable statutory mandate.

9. Categories of Information

The Company may collect, generate or infer personal data, identity data, contact data, KYC data, demographic data, financial data, behavioural data, technical data, metadata and derived analytical information.

10. Identity & Verification Data

This includes PAN, masked Aadhaar, offline Aadhaar artefacts, video-based verification, live photographs, facial recognition outputs and liveness detection data.

11. Financial & Risk Data

Bank account information, income indicators, repayment behaviour, internal risk assessments, proprietary scoring outputs and creditworthiness analytics may be processed.

12. Technical, Device & Location Data

IP addresses, device identifiers, GPS coordinates, cookies, SDK logs, timestamps, server records and telemetry may be automatically captured.

13. Communication Monitoring

All communications including calls, SMS, messaging platforms, emails and in-app interactions may be recorded, monitored and stored.

14. Purpose of Processing

Data processing is undertaken for eligibility assessment, verification, fraud detection, disbursement, repayment tracking, recovery, enforcement, audit, analytics, dispute resolution and legal compliance.

15. Surveillance & Monitoring Consent

The User expressly authorises call recording, location tracking, device monitoring, system logging and video verification as lawful and proportionate.

16. Data Sharing & Disclosure

Information may be shared with banks, payment intermediaries, KYC vendors, technology service providers, analytics partners, recovery agents, legal advisors and enforcement authorities.

17. Statutory Disclosure

Data may be disclosed to courts, law enforcement agencies or governmental bodies pursuant to legal process or compliance obligations.

18. No Fiduciary Relationship

Nothing herein creates a fiduciary, trustee, agency, partnership or employment relationship; the association remains purely contractual.

19. Data Ownership

All data, records, logs, analytics and electronic artefacts remain the exclusive proprietary property of the Company.

20. Retention Without Limitation

Data may be retained indefinitely irrespective of account closure for recovery, audit, enforcement, dispute handling and legal defence.

21. No Right of Erasure

The User expressly waives any right to deletion, erasure or anonymisation during subsistence of liability or any inquiry, audit or proceeding.

22. Electronic Evidence

Electronic records, OTPs, logs, timestamps and digital acknowledgements constitute conclusive evidence under applicable law.

23. Information Security Disclaimer

Reasonable technical and organisational safeguards are employed; however, absolute security of digital systems is not guaranteed.

24. Cyber Risk Limitation

The Company disclaims liability for cyber incidents, hacking, outages or unauthorised access beyond reasonable control.

25. User Obligations

The User bears sole responsibility for accuracy and truthfulness of information furnished and consequences thereof.

26. Third-Party Misuse

Unauthorised misuse by agents or third parties outside approved systems shall be deemed their personal act; the Company disclaims liability.

27. Waiver of Objections

The User irrevocably waives objections to lawful data collection, processing and disclosure to the maximum extent permitted by law.

28. Indemnity

The User agrees to indemnify and hold harmless the Company and its representatives against all claims, losses, penalties and costs arising from breach, misuse or false complaints.

29. False Complaints & Cost Recovery

Malicious or bad-faith complaints entitle the Company to recover costs and initiate civil and/or criminal proceedings.

30. Amendment & Survival

This Policy may be amended unilaterally without notice. All provisions survive termination or cessation of Platform usage.

31. Governing Law & Jurisdiction

This Policy shall be governed by Indian law. Courts at Jaipur, Rajasthan shall have exclusive jurisdiction.
